Abstract

The aim of the work is to propose a specific theoretical analysis of credit usury, a phenomenon of inherently opaque contours due to centuries of differing situations, analysis and judgments. The author identifies the usury market based on the definition of credit agreements entered into by a borrower of legal funds with a lender whose objective function contains at least one element of illegality. A basic model is first presented before two different configurations of the credit market are analysed, one with banks that operate in perfect competition and one in which they operate in monopoly. The author then looks to answer the question posed in the title, before going on to evaluate Italy’s new anti-usury law.
