Abstract

The present severe forensic interpretation about professional responsability of physicians has two effects, the first inducing an extreme caution in the strategic choice and a loss in the decisional autonomy of the doctor, the second changing the general architecture of the criminal law, because the principle of the objective liability is threatening to be a general principle.
